Terms & Conditions

1. Definitions

In these Terms of Use (Terms and Conditions) the following terms have the following meaning:

TU Delft Impact Contest: The Erasmus University Challenge is part of Soapbox BV, located and established at the Boschstraat 21, 6211 AS Maastricht, registered in the trade register of the Chamber of Commerce with the number 54104688.

Organiser: The (legal) person who organizes the Competition and / or offers it to the public or a specific target group. In this case the organization of the Erasmus University Challenge.

Competition: Activity in which Participants stand for election and the Organiser offers the possibility to vote (online) on a Participant.

Participant: A natural person who has created an account on our platform (https://www.erasmusuniversitychallenge.nl/) and has also agreed to agree with the privacy statement and the conditions of participation. Participation can mean participating yourself or proposing something / someone else.

Voter: a natural person who has indicated to vote on the profile of a Participant in a Competition and has also indicated that he agrees to the Participation Conditions.

Conditions of participation: These conditions of use offered by the Organizer.

Third: A (legal) person or company that is not affiliated organisationally or legally to the website, Erasmus University Challenge or Soapbox BV.

Partner Companies: Companies or educational institutions that have a partnership with the Erasmus University Challenge.

User / You: Participant or visitor of a website or online portal which is part of the Erasmus University Challenge.

 

  1. Applicability conditions

Only these conditions apply to the Erasmus University Challenge. These conditions only apply to the use by Users or visitors of https://www.erasmusuniversitychallenge.nl/.

 

  1. Responsibility for content

The website or online portals that support the website may also contain hyperlinks to websites or content from third parties or partner companies. Clicking on this will leave the online environment of the Erasmus University Challenge and you will reach the website of that third party. The Organiser has no influence on these websites or online portals. The inclusion or presence of third-party content on the website (s) or online portals that support this website does not imply that the Erasmus University Challenge endorses this content. Organiser does not accept any responsibility or liability for the content or use of websites or services of or offered by Third Parties.

 

On the website users and partner companies can create their own profile and place content. The Organiser does not monitor the communication between Users and the communication between users and partner companies. We therefore have no control over the quality, safety, legality, integrity or accuracy of the content placed by Users or Partner companies.

 

  1. Account

To participate in the Erasmus University Challenge, you as a User must create an account on the website. Users are obliged at all times to ensure that the information that is provided is complete and accurate. This also applies to personal data such as name and email address. The Organiser reserves the right to determine whether an account is actually awarded. The criteria for this are different, but in any case the account can be refused if the data does not seem to be correct. It is not allowed to create an account for someone else without his or her consent.

 

If you are younger than 16 years, a parent or guardian must give permission for creating an account. By agreeing to these Terms and Conditions you guarantee that you are 16 years of age or older. The websites and services of the Erasmus University Challenge do not intend to collect data about visitors younger than 16 years old. However, the Organiser cannot check whether a visitor is 16 years or older. If you are convinced that the Erasmus University Challenge has collected personal information about a minor without parental consent, please contact us via info@soapbox.nl so that this information can be deleted.

 

  1. Use of the website

The User warrants to the Organiser that he / she is entitled and authorized to make use of the website.

The website (s) or online portals that support the Erasmus University Challenge are compiled with the utmost care and made available to the Users. The Organiser expressly does not guarantee that the website (s) or online portals will be completely free of viruses, are accessible at all times, will work faultlessly and without malfunctions.

The User is not permitted to change, copy, damage, overload, impede, disable or interfere with the use and functioning of the website (s). Commercial (re) use of data originating from and / or displayed on the website (s) or via the online portals is not permitted, unless prior written permission has been obtained from Soapbox BV. With respect to this, all rights are expressly reserved.

 

  1. Intellectual property and other exclusive rights; privacy

All intellectual property rights, including but not limited to trademark rights, trade name rights, database rights and / or copyrights, with regard to the website (s) and the content placed thereon, such as design, texts, articles, (company) names and logos, exclusively to the Organiser. It is not permitted to delete or change notices or statements regarding intellectual property rights.

Intellectual property rights that are brought in by one of the parties (Users, Partners, Participants) as own logos, pictograms, texts, etc., will accrue to the party that contributes them.

The User shall not perform any acts that, directly or indirectly, infringe on exclusive rights, such as intellectual property rights of the Organiser, Partner companies or Third Parties.

With respect to the files, images, photographs and texts made available by Users on the website (s) or via the online portals for the public profile, the User Organiser will receive a free, unencumbered, worldwide, sublicensable , non-exclusive license to:

The files, data and / or materials to use, multiply, distribute and make public in connection with the services of the Erasmus University Challenge; and

The files, data and / or materials to use and multiply (and allow third parties to use and multiply) in any media for marketing and / or promotional purposes in connection with the services of the Erasmus University Challenge.

The User guarantees to be any entitled party with regard to the files, data and / or materials, or at least have sufficient rights to reproduce, reuse or make public the files, data and / or materials. The Organizer and / or Partner companies are not liable for any claims from Third Parties who object to the publication and use of files, images, photos or content as provided or published by Users on the basis of intellectual property rights and / or portrait rights and / or privacy rights that they have received. The User indemnifies the Erasmus University Challenge, the Organiser and Partner companies and all companies and persons associated with them from all Third Party claims that are based on the claim that the files, data and / or materials infringe on any applicable (intellectual property) rights. or portrait) right of third parties or otherwise unlawful towards third parties and for all claims arising from your actions in violation of these Terms and Conditions. All costs incurred and damage incurred by the Organizer in any way related to such claims shall be reimbursed by the User.

 

  1. Notice & take down procedure

If you notice that another person / third party infringes your (intellectual property, portrait or privacy) rights, please send an email to info@soapbox.nl. After receiving the mail, the Organiser will investigate this and take action as soon as possible. Your e-mail must contain the following information:

The URL on which the material that you believe is infringing can be found;

A statement, supported as far as possible with evidence, that and why, in your opinion, your (intellectual property or portrait) rights are infringed;

Contact information, such as your name, address, telephone number and e-mail address.

The Organiser reserves the right not to accept a request to remove or make content inaccessible if it has good reasons to doubt the accuracy of the notification or the legality of the evidence provided or if the content on which the notification does not appear to be unmistakably unlawful.

If you act contrary to the Terms and Conditions of Participation, the Promoter is entitled at any time to suspend (temporarily) suspend, suspend or delete an account.

 

  1. Prohibited or unlawful content

Content that you can never post or distribute via the website or the online channel that supports the Competition concerns / concerns:

  • Content that is discriminatory;
  • Content that calls for violence / bullying;
  • Content that is in conflict with good morals or good taste;
  • Content containing pornographic material;
  • Content with which criminal activities are promoted or committed;
  • Content with which (without the prior written permission of the Organiser) commercial activities are involved, such as advertisements, lotteries, competitions, or pyramid games;
  • Content in violation of any law, regulation or these Terms.

If it appears that the content is unlawful, it will be removed from the website by the Organisation or made inaccessible, at the discretion of the Organiser.

 

  1. Liability

Insofar as there is any liability on the part of the law on the Organiser or Partner companies, this liability to the User is limited to reimbursement of the demonstrable direct damage per event (whereby a coherent series of events counts as one event) and subsequently up to a maximum of € 10,000. , -.

The liability of the Organiser and Partner companies for indirect damage and consequential loss, including loss of turnover and profit, reduced goodwill, loss of data and immaterial damage is excluded.

A condition for the existence of any right to compensation is that the damage is reported to the Organiser in writing immediately after it has arisen. Any claim for damages against the Organiser expires by the mere lapse of 12 months after the occurrence of the damage.

The liability limitations of this article do not apply in case of intent and / or deliberate recklessness by the management of the Organisation.

 

  1. Communication regarding the Competition and prize package

If you as a user have questions about the online part of the platform, you can contact the Organiser by email, info@soapbox.nl. No correspondence will be sent about the result or the number of votes / participants in the Competition.

If there is a prize package, it can deviate. If there is a case of gambling tax, this will be for the account of the Participant.

Organiser is not responsible for the handling of the prizes.

 

  1. Other provisions

If one or more provisions of these Terms and Conditions are null and void or are nullified, the remaining provisions will remain in full force.

These Terms and Conditions have been drawn up and are governed by Dutch law.

Any disputes related to or arising from these Terms and Conditions will in the first instance only be submitted to the competent court in Maastricht.
